Combustible smoking has always been a threat to the health and hygiene of the people around. This is probably the reason for which you see advertisements and other awareness campaigns that are out there! In order to make sure that this nicotine consumption can be lowered and eliminate the huge health risks that cigarettes usually come up with, the Indian government has recently taken up the initiative of banning e-cigarettes. Thus, we often see statutory warnings coming up on the television and the movie theatres to make sure that the adults can choose things wisely and differentiate between what is right or wrong! Accordingly, they would be able to decide the kinds of risks that threaten their lives and opt for things!
Recently, there has been a lot of debate about the consumption of cigarettes and the protectionism theory that lies behind that. Definitely, tobacco chewing or smoking is a serious issue in India and the Electronic Nicotine Delivery Systems (ENDS) are raising a huge opposition to the tobacco farmers. With the vaping products getting immensely popular in the market, we see that a lot of importers and sellers are getting into the argument with a point that consumption of nicotine is only 5% harmful than that of consuming tobacco.

The govt of India feels that e-cigarettes are harmful and thus, they have decided to ban the product. In the year 2015, the Drugs Consultative Committee agreed that ENDs is not actually a drug under the Drugs and Cosmetics act, 1940. Again, in the year 2019, they said that end is a drug and thus, they have recommended for a complete ban on the manufacture and import of these ENDS under the Sections 26A and 10A.
The Delhi court and Bombay high court have held that ENDS are not drugs and therefore, they should not be banned under the Drugs and Cosmetics Act of 1940. A clear consistency and such a raging conflict that comes to a stand for the decision that has been taken by the Court’s and the central govt. Public health is a state subject and if is definitely a matter of concern and therefore, a decision taken by the states in regard to the scientific publications.
